NEW DELHI: In a setback to six Congress rebel MLAa from Himachal Pradesh who were disqualified by assembly speaker under anti-defection law for going against their party whip, Supreme Court on Monday refused to stay the order to allow them take part in House proceedings.
Agreeing to hear their plea against disqualification, a bench of Justices Sanjiv Khanna and Dipankar Datta made it clear at the outset that staying of Speaker’s order was not possible at this stage.
Court has sought response from the Speaker. It posted the hearing to first week of May.
